only legal if you're doing it as news. Documentary, not 100% sure. If it's for entertainment, find a free game & ask the creators if you can use that one.

If it's an educational film with specific commentary about the game, ie; "Playing DOOM increases aggressive behaviors in children ages 1 month to 9 months" sort of dialog, then it's educational in nature, and the video game may be used. If it's about teaching kids dexterity and the game DOOM is playing in the background, it doesn't meet the tests of Fair Use.

In particular the person is talking about how children are playing video games where they steal cars, murder prostitutes and shoot police and how this is not good for our culture. So this would qualify right? Is there somewhere I can get the text on this "fair use" to make sure the client is comfortable with any potential copyright issue?

i'm sure you're having facts stated, not just one sided nut-job arguments, correct? if it's the one-sided nut job thing then i wouldn't do it (unless, of course, you're under contract, then why worry, it's their issue with the copyright stuff).

This is an educational video on parenting so no we would not have the people who believe it's a good thing to play these types of games. Are you saying that this would then not qualify under "fair use" or just that you don't agree with our position?

I'm sure someone will correct me if I'm wrong but it likely has to do with slander/defamation if you are making statements like "GTA causes murders and mayhem." Without actual, verifiable, "expert" data, the publishers (I don't remember the name right now) of the game could sue you.

Well, come to think of it, they could still sue but at least you would have some type of court defense.

No, they are not making those types of statements. The basic statement is:

"When you play this game you go around stealing cars, shooting cops and can even murder prostitutes. This cannot be good for children."
