Client has lots and lots of footage of notable jazz performers performing. He has / will get written clearances from them. Now the gottcha that he forgot about is the copyright owners of the original works as that was "always somebody else's problem" that he never had to think about. Needless to say this time as he's no longer working for a network there isn't somebody else!
So my question is this. What's the norm for this for an indie production, we don't know what if any distirbution will occur so it's kind of hard to negotiate a price. Should we just get all the info in place e.g. cue sheets, who own copyright etc and then include that as part of what we offer for sale with the purchaser paying for the rights. We're not looking to make major money so no worries about us getting screwed in the deal, just want to cover costs and get the show seen. This is anything but top 40 material and the same tunes have been performed on air many, many times so I'm 99% certain getting the rights will not be an issue, just the paying for them.
