DVD-A2 bitrate over limit with 16 x 9

Just started doing some 16 x 9 stuff and noticed that even with the bitrate set in V5d to variable default, best, no audio, that on some portions the bitrate exceeds 8.6 and hits a peak of 9.4, both of which stop the player. This never happened with 4 x 3. DVD-A2 is set at 8.0 but the video is not being recompressed. My player has a continous monitor for bitrate on display and it choked at the 8.6 and 9.4 peaks. All the rest was 7.9 to 2.4. I thought that the limit was fairly well held in place at around 8.4 max on the 4 x 3 stuff but I never thought it would bump up to 9.4 without sound in the 16 x 9 mode. I really liked the defaults but how do I nail down those peaks at 8.0?
