If you're the producer who puts the ad on cable (programs it) then this is a good question of which I don't know the answer. If you're the producer that the company wants to produce an ad - and then THEY do something with it, I'd say make the ad and take the dough.

as a producer - if i questioned the legality, let alone the morality of half the the products / ideas i've been commissioned to produce, i'd be spending my days in a monastery begging forgiveness.

In April 1970, Congress passed the Public Health Cigarette Smoking Act banning the advertising of cigarettes on television and radio starting on January 2, 1971.

Smokeless tobacco ads, on the other hand, remained on the air until a ban took effect on August 28, 1986.
