OT- Video releases again

I don't mean to beat a dead horse as I know this has been brought up many times but I thought this might be of interest to some. The film tentatively titled "Rocky Balboa" is being filmed in nearby Philadelphia and some of pictures appeared in our local newpaper. A large sign was posted at the entrances to the area in which they were working:

"PLEASE NOTE:
THIS AREA IS BEING USED FOR FILMING THE MOTION PICTURE TENTATIVELY ENTITLED 'ROCKY BALBOA'. IT IS POSSIBLE YOU WILL APPEAR RECOGNIZABLE, THEREFORE, IT IS UNDERSTOOD THAT ALL PERSONS IN ATTENDANCE DURING TODAY'S FILMING THEREBY GRANT PERMISSION TO PRODUCTION COMPANY TO PHOTOGRAPH THEM AND USE THEIR LIKENESS IN CONNECTION WITH THE EXPLOITATION OF SAID MOTION PICTURE. AND IN ALL OTHER USES, INCLUDING BUT NOT LIMITED TO FEATURETTES AND MUSIC VIDEOS, THROUGHOUT THE WORLD.

IF YOU OBJECT IN ANY WAY TO THE FOREGOING, PLEASE STAY OUT OF THE AREA WHERE FILMING IS TAKING PLACE."

Yeah, I dont see how that flies either. Thats kind of like saying I am going to use your likeness if you remain silent and dont tell me not to. Im pretty sure there has to be releases signed somewhere otherwise why not get the proper license and secuirty to shut down the area until the scenes have been shot with those that have signed releases?

For ancillary faces, this is a common practice, and while it might not be airtight, it's been the norm for many, many years. It may or may not have been challenged, but it's akin to a "no trespassing" sign. "If you don't want to be sued for trespass, don't cross this line."
"If you don't want to be filmed, don't come in here."

Seems like plenty of notice to me, and given that it's how Hollywood has done it for years, it likely is pretty well tested.

They shoot lot's of exterior stuff for movies up here in Vancouver. We see signs like that all the time. It's the norm.

When you see a sweeping pan of a busy street at high noon, it's not likely that they're gonna be able to catch each person and get them to sign a release on the chance they MIGHT be in a shot for .6 seconds.

In a public place there is no expectation of privacy. I've heard that legal argument plenty of times especially in cases where local residents start filming people going in and out of porn shops or places where they deal drugs or pick up hookers. The sign, it would appear, is added coverage I guess.

They do the same thing here in Southern California Night Clubs. If an act is performing and filming... they will place a Big Placard at the front door stating that they are Filming. By entering you are giving consent to be in whatever VideoWorks they decide to do. Depending on the act... who knows where the final piece will turn up or in what it will look like? That's what deters me. I may want to run for President some day. I don't want them to know I was at an Eminem, GWAR, 2LiveCrew concert gettin my groove on.

I think that's adequate to post a placard like that at the entrance(s). Basically, you know before entering the area what you're getting yourself into. If you're not into it... turn and walk away. Or would that be RUN?
