It all depends on the shape of your picture. Ideally the picture should have a size ratio of just about 4:3, or 4 wide by 3 high. If your picture is taller or narrower than this ratio then you'll end up with black on the sides to make up the extra horizontal space that your picture lacks. If your picture is wider or shorter then you'll end up with black on the top and bottom to make up the extra vertical space.

but on my old scanner I never had the black bars at top and bottom just the sides

Perhaps the new scanner auto-crops slightly differently, or it scans the height and width dimensions differently than the old scanner did.

I usually try to scan more of the picture than i want to show on the screen, then use Pan/Crop to crop in slightly and make sure that the picture bleeds over the edges.
