Pardon a sort-of commercial post, but this may be of interest to anyone contemplating a Screenblast purchase.

I'm selling my copy of Screenblast Movie Studio 3 on eBay. I'm now using Vegas 4 (Screenblast's older brother, also by Sony, for those who dont' know), so I don't need both. Starting price is $25, with no reserve.

is it legal (in accordance with the user license) to sell the software? will sony allow the software to be registered a second time on a different computer?

SONY will allow a transfer of a valid license to another party as long as the entire package is transferred, the original party does not retain the license or the installation, and SONY is notified of the transfer. This is all perfectly fine and SONY will issue a new serial number to the new owner.

The question however, is whether the license is still valid after using it to upgrade to a different license. There's lots of debate on this issue and companies have taken stands on both sides of the issue. Some say that you forfeit the old license in return for a discount on the new. Others say that you've paid for both so you deserve to have both. As far as i know, there is no legal regulation on this issue yet, so for the time being your best bet is to follow the software manufacturer's license agreement. Unfortunately, i don't believe SONY addresses this issue in their license agreement.

In other words, *shrug*, i dunno. If a federal law is passed governing this issue then it will override any individual license agreements sold (or resold) after the law goes into effect, but it probably won't govern existing licenses.

should be ok... I dont think they offer a Vegas upgrade. I think the user purchased Vegas normally...thereby getting a full lic.

I doubt highly that this was an upgrade from Screenblast to Vegas since the upgrade price from Sony is more than the street price to buy new. I always assumed that an upgrade did not entitle you to sell the older software. Some companies like Ulead actually enforce this by looking for the older installation so I have to keep both my copy of Cool 3D 3.5 and upgrade to Cool 3D Production Studio together because I can’t install the latter without the former. Sony does not enforce this in their installation so its anybody’s guess what their policy is. I couldn’t find it written anywhere either.

I was the original poster. I just want to confirm that yes, I purchased the full version (i.e. not upgrade from Movie Studio) of Vegas, for the very reason JR mentioned: street pricing for full version of Vegas is better than Sony's upgrade price from MS to Vegas.

I'm also assuming that selling my "entire" Screenblast (box, manual, original CD with original registration key sticker) is legal by Sony as I couldn't find any specific information prohibiting this. If not, Sony please let me know.

Check out paragraph "5." of the End User License Agreement. They tell you right there what the requirements for transfer of license are. It's definately allowed as long as you don't retain any of it yourself.

Thanks for that, Chienworks. Just looked at paragraph 5. It doesn't say anything about notifying Sony of the transfer or the new user obtaining a new registration number (something you mentioned in an earlier post in this thread). Do you know where that's referenced? For those interested, full text of para. 5 in the EULA as it appears in my user manual is:

"5. ASSIGNMENT. You may assign the Software to a third party only if they agree to be bound by the terms and conditions of this Agreement. If you assign the Software, your rights under this Agreement will terminate immediately and you may not retain the original or any copies of the Software."

Notifying SONY about the transfer has been mentioned in here by SONY employees several times. It seems a sensible thing to do. It will of course invalidate your own serial number, which isn't a bad thing because it's not your license anymore, and it gives the new owner their own serial number which is a good thing in case they ever decide to abuse it and install it many times. In that case the serial number being abused would point to them and not back to you.
