If you shoot video of a public event (e.g., graduation, festival) and produce a DVD for sale, what are the implications with regards to the "general public" who will appear in the footage?

Are you open to legal action by the passerbys or participants in public events who end up in your DVD?

Can my DVD be Copyrighted?

Some of these answers will depend upon whether you are shooting this event on your own, or if you were hired by the group sponsoring the event.

I "believe" if it is produced like a documentary of an event that it is not a problem. I remember seeing an answer to this on another website in the past, regarding incidental photographing of passers-by in documentaries and news events.

I think it becomes a problem if it is produced as a work of fiction, and the passers-by can easily be identified.

Of course, in todays climate . . . . . .
