Spot is making a good point.

Lawyers give professional advice. If they do more than that, they are not there in a capacity as lawyers but as negotiators.

If you want to get the best deal possible, you need to understand all the key issues yourself, to the point where you know when you need to ask your lawyer.

I spent 20 years negotiating international IPR agreements in 52 countries, most of them between $100K and $1M but also some larger than that. I got more than $100M of business from mostly large companies and government agencies, in competition with some of the world's largest and toughest companies.

The ONLY reason I was able to get most of these deals was that I understood every paragraph, sentence and comma of the necessarily complex agreements.

I could modify them to suit any need within minutes or hours, and sign them knowing that I hadn't committed my company to something we'd regret later.

I could never have done these agreements without understanding them fully.

How can you trust a lawyer to have the business judgment for you? That would be like trying to delegate responsibility.

Mark Litwak is a very clear-spoken entertainment lawyer in Los Angeles, specializing in Indies (including many at Sundance this week). He has written a number of books that can be found on Amazon, and he does seminars at UCLA about film financing and IPR agreements. Highly recommended if you want to understand the issues enough to actually negotiate them.

Are these deals traditionally compensated via cash, check, credit card or Pay Pal? If cash, can it be in small denominations? Can I pay my IP attorney out of my back-end?

That was entirely uncalled for pmasters. I've seen Spot spend much time answering your questions (as many others) in a very civil way even if his take is 180 degrees from the poster's. While he may disagree or be disagreed with, has never resorted to... shall we say ethnic low blows. He's been nothing but cordial in every post of his I've seen even though some he totally disagrees with the poster including myself or the reverse.

I've been sympathetic to your much of your grief and agreed with some of your political statements but attacking Spot in such a way is distasteful and discrediting..

P.S. If you think clamping down on porn is going to save society, you're mistaken. Do you really think those that crave porn, if made unavailable (impossible) that actually commit crimes based for some reason on porn (if that's actually possible) wouldn't if porn paraphernalia was obliterated?

Further, if you re-read my post, I'm not advocating the material. (or not advocating the material. I'm neutral on this issue) I do appreciate the benefits you and I enjoy because of that industry though. Internet, VHS, no taxes on blank DVDs, and freedom of speech laws. Their fight for free speech allows you to make religious statements regardless of whom it might hurt at the same time as it allows them to make the movies they choose to make.
The adult industry has also created all sorts of pro-forma contracts that have become more or less standardized in terms of pre-production, production, post production, distribution, ownership, and other related agreements. The adult industry outputs 14 times the number of films that the non-adult film world puts out. The sheer numbers have required them to break a lot of ground. IMO, that's pretty admirable, regardless of what the catalyst has been for them to do so, or who/what they produce.
I'll wager that fast food, alcohol and cigarettes have taken far more lives and induced more crime than adult movies any day of the week.
