No, youtube has an agreement and a database of record labels etc that will allow or not allow their music to be used. I have several videos with copyrighted music that get flagged by youtube and thus get ads placed over the video. I cannot opt out of the ad because that is how youtube gets the revenue for using the copyrighted music. If the producer or label does not agree, then the audio is muted or you are sent a notice that the video will be deleted if you don't delete it. So far I have not had any videos muted or deleted, just flagged and ads. The music industry is very aware of what is being used on youtube.

Thanks david-tu. Very informative. Just out of curiosity, when you say the ads get placed "over the video" do you mean they actually overlay the video as it's being played, or is the add played as a pre-roll before the video starts?

They are overlaid as lower thirds. I am sure you see them if you watch many videos.  You can close them out, but sometimes there is more than one and you don't have any say of what the ads are.

I understand you may also get pre-roll ads, even unskippable ones. I think the Content ID rights holder simply has a choice of block, monetize, track or route for review.
