There is an article in the Sunday NYTimes (writtenby a law professor) presents the quandry. Congress sets copyright policy, and latest version is in the DMCA.

Internet Business are held blameless and indemnified against copyright violations if they respond to copyright owners request to remove marterial. The burden of discovery is placed on the copyright owner. AFIK, YouTube complies.

The problem arises when the Supreme court ruled in the Grokster case that providing a technology that enables wrong doing makes one liable.

The standardized format (this case .flv) plays into it's success actually. Now you/people here may know how and are willing to resolve any player or codec issues with many diff formats/etc on a sharing site...but the kids/average mom & dad/etc. havn't a clue or the time. In updating the flash player you now have an easier route to gather a larger audience.

Sure flv isn't the format of choice for many but it resolves a lot of these problems and it's fine for what it is. It's also another reason in which utoob makes for an EXTENSION of the CRAP on TV (not a replacement for it).
