Bought MS18 since it said it was an upgrade to VEGAS MS 17 - refund?

Mark-Reed wrote on 7/15/2021, 7:54 PM

Well, I got a popup saying MS 18 upgrade is out... it popped up in my Vegas Movie Studio 17 app. So, I bought it.

As all the posts here say, its NOT an upgrade... its a whole different product that Magix misled everyone about. I have emailed support asking for a refund and no one is replying to me.

I do not want this piece of garbage MS 18 "upgrade" It is horrible. How can I get a refund to put towards Vegas Pro 18?

Anyone from Magix monitor the forums that can help?

This is a user to user forum.....

As for the "upgrade" software being "horrible", it might be for you. It's different, but horrible is subjective.

I'm not "anyone from Magix" (see my profile), but regarding refunds, you need to inspect the current MAGIX General Terms and Conditions for your area linked below (or try the email addresses mentioned in them). Unfortunately the policy has changed recently. T&Cs below dated "as of May 2021". (Basically you need to contact shop@magix.net)

https://www.magix.com/us/terms-and-conditions/

https://www.magix.com/int/terms-and-conditions/

(vegascreativesoftware.com has similar T&Cs)

In those T&Cs please note: "§ 3 CONSUMER CANCELLATION POLICY REGARDING DISTANCE SALES CONTRACTS Only for consumers who are habitually resident in a state that is a member of the EU or the EEA, this § 3 applies."

I don't think anyone's happy with that restriction.

Reyfox wrote on 7/16/2021, 5:56 AM

@vkmast what about this?

"For consumers who are habitually resident in a state that is neither a member of the EU nor the EEA, German law applies, excluding the UN sales law and German consumer protection law. Regardless of this choice of law, consumers are always subject to the mandatory consumer protection laws of the state in which they have their habitual residence at the time the contract is concluded. MAGIX also has the right to bring proceedings against the Customer at its general court of jurisdiction."

I have to admit, this is way above my pay grade. I find it difficult to accept that if you want a refund within the required time frame, that you would/should get it. Otherwise, this is a horrible business practice that will reduce the company sales only to the EU member states at the exclusion of rest of the world. Magix does have offices in the USA and Canada, where I am sure, they are under the rule of law there.

@Reyfox as I said above I don't think anyone's happy with this (except maybe the lawyers with their pay grade if it comes to that).

One of my forum members has reported back to me, after attempting to request a refund for Movie Studio 18.
Magix is officially denying refunds!
@vkmast You were correct - they are hiding behind the terrible new Terms of Service.
I posted a copy of the letter from Magix Sales Department here:

@Dr Zen this is horrible business practice. Every editing software that I have, has a refund policy. Magix is side stepping this by having their "office" in a State that does not have any regulations regarding digital download refunds.

As of 2020, here is the law regarding Return and Refunds:

https://www.termsfeed.com/blog/return-refund-laws-usa/

I am sorely disappointed in Magix. It looks like they will be losing a ton of potential customers for any of their products, not just video editing. And of course, the internet never forgets...

OMG. Combine this with the misleading upgrade offer - it could well be viewed that MAGIX have deliberately set out to run a scam specifically designed to limit customer comeback. If that is the case, that is unconscionable conduct IMO.

As mentioned in another thread just before by a disgruntled victim, a charge back through the credit card provider is probably the way to go - but maybe not so easy or possible if a debit card or direct debit was used.

I'll stick with Vegas Pro but absolutely no more MAGIX products for me like Sound Forge Pro.

Really not looking forward to the Press comments in the near future. Massive harm will be done to Vegas by association. Not fair.

I suspect it may not be deliberate but another stuff up by "Sales & Marketing" who appear to live on another planet. Remember the Steam fiasco.

Magix/Vegas (for yes sadly it involves Vegas) need to get the refunds sorted quickly. Should a US customer take action in the US for misrepresentation / misleading conduct I doubt that the US legal system would look kindly on it. They wouldn't just be required to refund but might also get hit with a hefty penalty.

I just add this capture for the records

Dexcon wrote on 7/17/2021, 7:21 AM

That is very interesting @FayFen in that MAGIX has highlighted it as a new product on that webpage. It's a pity they weren't so upfront about that in the 'upgrade' offer pop-up where Movie Studio 18 was portrayed as something different which has clearly sucked in many now disgruntled customers. If MAGIX stated in the pop-up that VMS was being discontinued (or something like that) and that they were now offering a replacement new product, it would have been better if they had described it that there was a now a special price to go to that new product. Far more honest that way.

Even when I open VMSP13 (Sony), I get the pop-up:

To me, and I suspect most VMS users, "New" indicates a new version is available not a completely new different product. After all it is in the Vegas products page, not the Magix products page.

Today I became a victim of Magix misleading marketing team about this fake upgrade 😡

I tried this so called V18 upgrade for few minutes then uninstalled it.

I just sent Magix email requesting refund. If for any stupid reason they refuse to refund me, then this proves that Magix become evil and greedy and they intended to mislead people in that upgrade scam. If that happens I will not trust this unethical company anymore.

vkmast wrote on 8/7/2021, 7:01 PM

@True-H if you're denied the refund, try and see if "a charge back through the credit card provider" (or PayPal) as Dexcon suggests in a comment above would work.

Yes I will contact my credit card if they deny my request and I will not upgrade my VP18 to V19 and will not buy any Magix products any more. Maybe better start looking for alternatives from now.

magix sent me this email when I asked for refund

clearly they are rejecting my refund, indirectly, and this force me to disrespect this company behavior and stop buying all their software from now own. they totally lost me and will lose so many customers because of their scam.

Just give the feedback you're asked and renew your request for a refund.

Please note that cross posting in multiple threads should be avoided (see CR #3). It does not help in your case. Next time, please create a new post (separate thread) for this. It may even be better noticed by those in the same predicament.

@True-H

I am not interested in giving any feedback about Movie Studio 18. All I was asking for a refund for a product that was uninstalled after few just minutes so clearly I hate it.
